Terms and Conditions of Use

1. The Service

By using Fishie.app ("Fishie" or "the Service"), you fully accept these Terms and Conditions. Fishie is a digital platform that lets you record fishing trips ("Diary"), manage your gear ("Arsenal"), get personalized forecasts based on your history and marine weather conditions, and view information on fishing rules and restricted areas.

2. Access Requirements

To use Fishie you must:

  • Be at least 16 years old; users aged 16–18 must have parental or legal guardian consent
  • Provide accurate, up-to-date identifying information
  • Use the Service lawfully and in compliance with applicable regulations

3. Subscriptions, Free Trial, and Renewal

Fishie offers free features and paid subscription features on monthly or annual billing. After any free trial, unless you cancel, your subscription activates automatically and renews at the end of each period on the same schedule, unless you cancel before the renewal date. Payments are processed through Fishie.app via Stripe. You can manage, change, or cancel your subscription from your account area on the website/app, or by contacting info@fishie.app.

4. Right of Withdrawal and Refunds

This section governs the right of withdrawal for paid subscriptions (monthly and annual).

You may withdraw from the subscription contract without giving reasons within 7 (seven) calendar days from the date of purchase or paid renewal (monthly or annual).

To withdraw within that period, send written notice to info@fishie.app with your identifying details and purchase date. If withdrawal is timely, Fishie refunds the amount paid using the same payment method used for purchase, unless otherwise agreed, within a reasonable time and no later than 14 days after receiving your request.

After 7 days from purchase or renewal, the subscription is non-refundable except where mandatory law requires otherwise. This applies to the first purchase and each automatic renewal: the 7-day period starts again from each charge. You may cancel your subscription at any time from your account area or by emailing info@fishie.app to avoid the next automatic renewal; cancellation does not automatically entitle you to a refund of amounts already charged, except as stated above.

5. Acceptable Use

You must not:

  • Use Fishie for unlawful purposes or in breach of fishing, environmental, or safety regulations
  • Manipulate, alter, or attempt to compromise Service data, systems, or infrastructure
  • Copy, decompile, reverse engineer, or otherwise attempt to extract Fishie algorithms, predictive models, or source code
  • Share your login credentials with others or create accounts with false information

6. Intellectual Property

The Fishie logo, name, algorithms, predictive models, editorial content, and all other distinctive elements are the exclusive property of Fishie or its licensors. Unauthorized use, reproduction, distribution, or commercial exploitation is prohibited.

7. Limitation of Liability

Fishie does not guarantee fishing success. Forecasts are based on historical data, your personal statistics, and marine weather conditions, and are provided for informational purposes only.

Fishing rules and area information:

Information on ordinances, marine protected areas, fish restocking zones, or other regulatory restrictions in Fishie is provided for general information only, based on sources available when content was updated. It may not be real-time, complete, or error-free. You alone are responsible for verifying restrictions with competent official sources (harbor authorities, coast guard, regional bodies) before fishing. Fishie is not liable for penalties, legal consequences, or damage arising from relying solely on Service information.

Fishie is also not liable for injuries, accidents, or damage arising from fishing activities, including spearfishing and diving, which remain entirely your responsibility in compliance with applicable safety rules.

8. Account Deletion

You may request deletion of your account at any time by contacting info@fishie.app. Fishie may suspend or terminate accounts for breach of these Terms, suspicious or fraudulent activity, or at the request of competent authorities.

Account deletion does not automatically entitle you to a refund of amounts already paid, except as set out in Section 4.

9. Governing Law and Jurisdiction

These Terms are governed by Italian law. For disputes relating to interpretation, performance, or validity of these Terms, if you qualify as a consumer under the Italian Consumer Code, the exclusive jurisdiction is the court of your place of residence or domicile; otherwise, the Court of Milan has exclusive jurisdiction.

10. Changes to These Terms

Fishie may modify these Terms at any time. Material changes will be communicated by email or in-app notice with reasonable advance notice. Continued use of the Service after notice constitutes acceptance of the updated Terms.
